White’s latest legal loss could cost him his job
December 23, 2011 No commentsA judge has reversed a decision by the Indiana Recount Commission and ordered it to decertify the 2010 election of Indiana’s embattled Republican Secretary of State.
Charlie White in now out as Secretary of State. The opponent he defeated in 2010, Vop Osili, has been declared the winner and will assume White’s seat.
That was the ruling of Marion County Circuit Court Judge Louis Rosenberg.
He declared the embattled White was not eligible to be a candidate, therefore is not eligible to serve and should be replaced.
This ruling reverses an earlier decision by the Indiana Recount Commission.
Since the election, democrats have argued White, a Republican, illegally registered to vote in the 2010 primary at his ex-wife’s address, when he also had a condo with his then-fiancee.
In his ruling, Judge Rosenberg said “The fact that Mr. White knowingly registered in the wrong precinct is sufficient to render him ineligible for the office of Secretary of State.”
A.J. Feeney-Ruiz, a spokesman for the Recount Commission. says they will request an immediate stay of the ruling and plan to appeal.
The commission likely will meet after the holidays.
Both sides say this ruling is not the end, that the case will likely land in the state supreme court.
But democrats still call it a victory for Indiana.
Charlie White still faces separate criminal allegations, including voter fraud, which he’s denied.
Earlier this week, A Hamilton County judge refused to dismiss the seven felony counts.
That criminal trial is scheduled to start at the end of January.
If White is convicted of any of those seven counts, his office becomes vacant and the governor would appoint someone to fill the position.
