• Parents of boy who drowned in baptismal pool files tort claim

    The parents of a boy who drowned in a baptismal pool at an Indianapolis church daycare ministry have filed a tort claim against the Family and Social Services Administration.

    The Indianapolis Star reported Tuesday that an attorney for Juan Cardenas and Maricela Serna sent a letter to several state agency staff saying FSSA “negligently inspected the Praise Fellowship Assembly of God church daycare” before and after the Feb. 22 drowning of 1-year-old Juan Carlos Cardenas.

    The boy apparently was eating lunch with other children inside a playroom when he slipped out unnoticed. Employees found him face down in 2 feet of water.

    A spokesman for the attorney general’s office says it’s reviewing the complaint. FSSA declined to comment.

    The couple’s attorney says they’ve settled a lawsuit with the church. The case has drawn attention to the state’s daycare laws, which exempts church-run daycares from the regulations that licensed daycares follow.
